Financial services regulation in the UK is complex and the penalties associated with getting things wrong are significant. The expectations of the regulators in respect of Chairs and Non Executive Directors are considerable and in some circumstances Chairs and Non-Executive Directors can be held personally accountable.

The purpose of this training is to equip Chairs and Non Executive Directors who are not familiar with the UK regulatory regime with an understanding of the UK regulatory framework, key legislation, the regulators and their tools, and key rules that apply both to firms and individuals.

The session will be fully interactive, using live examples of good and bad practice, and covering a wide range of crucial areas, including:

  • UK regulatory framework – which activities/products are regulated; the regulators, their objectives and tools
  • key legislation and rule sources; high level regulatory principles/rules; firm authorisations and permissions; and individual accountability (SMCR)
  • Key areas of regulation – customer classification; conduct of business (including Consumer Duty and product governance); prudential (regulatory capital, consolidation etc); firm governance, culture and risk management; markets regulation; complaints handling, FOS and compensation.
  • Regulatory processes and engagement with regulators – PRA/FCA supervision; notifications; information gathering; skilled persons; and enforcement.

This session will be delivered by experts at Herbert Smith Freehills, the global law firm. The course will be led by Clive Cunningham, a Partner and expert in UK financial services regulation who has over 30 years’ experience both as a regulator and providing advice to clients across the industry.
